Terms of Use (TOU)
These TOU define the rules for using the Besta platform, including the public mobile application and the Pro Space for establishments.

1. Presentation of the application and service
Besta, located at 60 Rue François Ier, 75008 Paris – France, publishes:
- A public mobile app to view events.
- A SaaS platform (Pro Space) allowing establishments to manage and publish their events.

2. Purpose of the TOU
These TOU define the conditions under which users and establishments access and use the services offered by Besta.
3. Access to the service
Mobile app: free and open access.
Pro Space: requires a secure account via BetterAuth and Supabase, with manual validation of establishments.
4. Service operation
4.1 Event publication
Establishments can:
- Create, modify, and delete their events;
- Add photos, descriptions, schedules, prices, activities, themes;
- Track consultation statistics (based on their plan).
Each published event consumes one credit according to the chosen plan.
4.2 Notifications and visibility
Push notifications can be sent to users (automated via Vercel cron).
Premium events benefit from enhanced visibility (app, emails, social media, notifications).
4.3 Service availability
Besta strives to ensure continuous service access but may perform maintenance, technical interruptions, or updates.
4.5 Community photo gallery
Besta provides all connected users the ability to publish a photo associated with each event. This feature creates a community gallery where:
— All users can view photos published for each event;
— Users can express appreciation by liking a photo (one like per user per photo);
— Besta awards badges to users based on their activity and community engagement;
— Photos are subject to moderation to ensure compliance with rights and usage conditions.
Detailed conditions regarding photo publication, likes, and badges are outlined in sections 4.6 and 4.7 below.
4.6 Community Feature — Photo Publication and Sharing
4.6.1 General description
Besta offers a feature that allows any connected user to publish photos associated with events to create a community gallery. These photos, once approved, are publicly visible to all users of the application.
4.6.2 Publication conditions
A user can only publish a photo linked to an event if:
— They have an active user account on Besta.
— The event is identified in the system (past or ongoing).
— The photo is published within a maximum of 48 hours following the event start date.
— The user publishes only one photo per event.
— The photo complies with the conditions outlined in section 4.6.3 below.
Beyond this 48-hour deadline, no photo can be published for that event.
4.6.3 Prohibited content — User responsibility
The user commits to publishing only photos they own the rights to and which comply with the following conditions:
— No photographs of third parties without explicit authorization from the person photographed. The user is solely responsible for obtaining the consent of identifiable persons in the photo, particularly regarding image rights.
— No content protected by copyright, registered trademarks, or other intellectual property without prior authorization from the rights holder.
— Formal prohibition of sexual content, nudity, violence, hate speech, discrimination, or any illegal content.
— Prohibition of defamatory, slanderous, or content affecting a person's privacy or honor.
— Prohibition of false content, montage, or misleading images intended to deceive.
Besta reserves the right to:
— Refuse publication or approve a photo following a moderation process (manual or automated);
— Delete any non-compliant photo without prior notice;
— Suspend or close the user's account in case of repeated violations.
4.6.4 Rights granted to Besta
By publishing a photo, the user grants Besta a non-exclusive, free, worldwide, and perpetual license allowing Besta to:
— Display, reproduce, and distribute the photo within the mobile application and its related media (website, social networks, marketing communications);
— Create excerpts or thumbnails for promotional purposes;
— Compile the photo with other community content to create galleries or editorial content.
This license grants Besta no exclusivity rights; the user retains their rights to the photo.
4.6.5 Moderation and deletion
Besta moderates published photos to ensure compliance with the conditions outlined above. This moderation may be:
— Manual, performed by the Besta team;
— Automated, via detection tools based on artificial intelligence or predefined rules.
A photo may be deleted at any time, even after initial approval, if deemed non-compliant. Besta will notify the user when deletion results from a clear violation of the TOU.
4.6.6 Public visibility
All application users (connected or not) can view published photos for each event. The author's email or personal data are not displayed publicly. Only the profile name (if provided) is visible next to the photo.
4.6.7 User responsibility — Indemnification
The user assumes full responsibility for photos they publish. They guarantee they have all necessary rights and commit to indemnify Besta against any claims, legal action, fines, or damages resulting from photo publication (image rights infringement, copyright violation, illegal content, etc.).
4.7 Likes and Badges System
4.7.1 Likes system
All connected users can express their appreciation for published photos by clicking a "like" button. Each user can only like a photo once. The number of likes is publicly visible on each photo.
Besta ensures system integrity by implementing anti-fraud measures based on detecting abnormal activity (scripts, bots, mass non-organic votes). In case of fraud detection, Besta may cancel generated likes and suspend the associated account.
4.7.2 Badges system
Besta may award users non-monetary virtual rewards called "badges." These badges:
— Are visual or text elements displayed on a user's profile;
— Have no contractual, monetary, or commercial value;
— Grant no particular legal rights or advantages;
— Solely aim to recognize and value community engagement.
Examples: "Photo of the Day" badge, "Active Contributor" badge, "Best Series" badge, etc.
4.7.3 Attribution conditions and criteria
Badges are automatically awarded according to criteria defined by Besta and subject to regular evolution, including:
— Number of likes received on published photos;
— Number of photos published;
— Community engagement (likes given, comments, etc.);
— Other additional criteria defined per temporary campaigns.
Besta reserves the right to:
— Modify, add, or delete badges at any time without notice;
— Modify attribution thresholds or criteria;
— Revoke a badge awarded if fraud or TOU violation is found.
4.7.4 No commitment or acquired rights
Badge attribution creates no ongoing obligation to the user. Besta may discontinue the badge program, delete or modify attribution criteria at any time, including retroactively if necessary. The user accepts that badge absence or loss entitles them to no recourse, compensation, or refund.
4.7.5 Badge deletion
In case of user account deletion, TOU violation, detected fraud, or for any other reason, Besta may delete all badges associated with the account. Badge deletion is non-negotiable.
4.4 Integrated Ticketing
Besta offers establishments an integrated ticketing module enabling online ticket sales. In this context:
— The establishment creates a ticketing page, defines pricing tiers and promo codes, and receives payments directly through their Stripe Connect account.
— Besta acts as a platform operator and charges a commission on each sale based on the plan subscribed at the time of ticketing creation (rate locked at creation date).
— Tickets may be nominative if the establishment enables this option (name and/or date of birth per ticket).
— Tickets are digital, accessible on a public page, downloadable as PDF and compatible with Apple Wallet / Google Wallet.
— The establishment is responsible for holding the event. In case of cancellation, it is the establishment's responsibility to organize refunds in accordance with applicable law.
5. User obligations
5.1 General obligations
The user commits to:
- Providing accurate information upon registration;
- Using the platform in compliance with the law and these TOU;
- Not compromising security, proper operation, or service integrity.
5.2 Prohibited content
It is strictly forbidden to publish or distribute:
- Illegal content (hate speech, crime apology, violence...);
- False information or fictional events;
- Non-copyrighted or copyright-protected images;
- Defamatory, discriminatory content, or content harmful to third parties;
- Dangerous, fraudulent events, or those attempting to circumvent the law;
- Photos of third parties without explicit consent or without respecting image rights;
- Photos protected by copyright or any intellectual property without authorization;
- Sexual, nudity, or violence content.
Besta reserves the right to delete any non-compliant content and suspend the account concerned.
5.3 Responsibility for rights and published content
The user commits to:
- Obtaining explicit consent from any identifiable person on a photo before publication;
- Publishing only content they legally own the rights to;
- Indemnifying Besta in case of claims related to image rights or intellectual property.
5.3 Ticket buyer obligations
Anyone purchasing a ticket through Besta agrees to:
— Provide a valid email address to receive their confirmation.
— If nominative tickets are required: provide accurate name and/or date of birth per ticket.
— Present a valid QR code at the event entrance.
— Not transfer, resell, or falsify purchased tickets.
Nominative tickets are strictly personal. In case of unauthorized transfer, entry to the event may be refused.

7. Personal data
Data is processed in accordance with the Privacy Policy and GDPR.
7.1 New data collected — Community photo feature
Within the photo publication feature (section 4.6), Besta collects and processes:
— Photo metadata: storage URL, publication timestamp, number of likes, approval status;
— User activity: photos published, likes given/received, badges awarded;
— Technical data: device information, IP, access logs;
— Moderation data: logs of photo rejections or deletions (internally only).
This data is collected based on contract execution (platform use) and Besta's legitimate interest (service improvement, fraud prevention, moderation).
Photo and metadata hosting is provided by a third-party provider compliant with GDPR.
7.2 Right to delete photos
Any user can request deletion of their photos at any time, without prejudice to moderation provisions (section 4.6.5). Deletion is completed within a maximum of 30 days. Account deletion results in anonymization of user data related to photos (name removed, activity disassociated).
Besta uses compliant providers (Supabase, Vercel, Stripe, Expo Notifications...).

8. Intellectual property
All Besta content (texts, images, code, logos) is the exclusive property of Besta. Any reproduction or distribution is prohibited without permission.
9. Termination
Besta may suspend or delete an account for non-compliance with the TOU, fraudulent use, or at the request of the establishment.
10. Service and TOU evolution
Besta may modify features or the TOU at any time. Using the service after modification implies acceptance of the new conditions.
10.bis Right of withdrawal — event tickets
Pursuant to Article L221-28 12° of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure service contracts for specific dates or periods. Tickets purchased on Besta for events with a fixed date therefore do not give rise to a right of withdrawal.
11. Applicable law and jurisdiction
The TOU are governed by French law. Any dispute will be submitted to the competent courts of Paris.
